Markanaliz is a registered trademark of Sistem Patent. It is special software developed by Sistem Patent with a database which is built in Sistem Patent where the registration criteria of the trademarks are determined, the reports are received and the monthly applications are compared. With the Markanaliz Service, reporting and follow-up of trademark applications made in Turkey and abroad will be performed.
An average of 10000 applications is published in Turkish Patent and Trademark Authority each month. After the trademark is registered, other companies in the sector can apply for similar trademarks. This is published in the official trademark newsletter. If this trademark published in the newsletter is not appealed, the trademark is registered. Through a program, trademarks among the trademark applications should be scanned for their similarities. While the trademark experts of the Turkish Patent Institute evaluate the brand, they can decide whether or not the mark is similar with their own point of view. With the trademark tracking method, you can appeal against similar trademarks which may harm your commercial value determined to be similar by the Turkish Patent Institute within 3 months after publication, i.e. the announcement phase. In line with this demand, the Trademark Re-examination and Evaluation Board (YİDK) examine the trademark in terms of similarity. If the trademark is found similar, the trademark application is rejected. Trademarks similar to the trademark registered at the time of publication may cause damage to the other trademark on the market in the long run. At this stage, the appeal to trademark registration is only possible with the case to be filed at the industrial property court. It should be noted that the registration of a trademark does not imply that the trademark is fully protected.
The Turkish Patent and Trademark Authority have a duty to notify the applicants of other trademarks registered with each application made.
