Hague System for Design Registration

Protection of design registration is national. In other words, an application made only gives the right of protection within the territories of that country. For instance,if a design registration is acquired in Turkey, it will only protect you against others making, selling, or using within the borders of Turkey. It is an international registration system based on the Hague agreement held by WIPO, the World Intellectual Property Office, which is one of the international design registration systems.
 
With this system, registration protection is ensured by a single application in the countries which are party to the system. Turkey is also a party to this agreement since 2004.

AIM OF THE HAGUE SYSTEM

There are two main purposes of design registration through the Hague system:
  1. Providing registration protection in the desired country through a single office,
  2. Carrying out registration and post-registration transactions from one place and only by one application. 

PROCESS OF DESIGN PROTECTION WITH THE HAGUE SYSTEM

It is an international system that provides design registration protection in countries that are party to the system, through a single application to the World Intellectual Property Office, WIPO.
 
Since Turkey is included in this system with the 1999 Geneva Convention, protection may be provided in the countries which are parties.
 
There is no design registration application or registration requirement in a country for international design registration protection with The Hague system.

BENEFITS OF DESIGN REGISTRATION WITH HAGUE SYSTEM

Generally, design registers provide protection at the country of application. If registration protection is required in more than one country, it is necessary to apply separately for each country's office. This brings with it many problems such as separate application, separate proxy, separate fee and translation into the country language if necessary. However, if applying through the Hague system of international design registration, a single application from a single location with a single language will suffice. This registration protection will ensure a normal registration application in each country separately. 
 
The second advantage of the system is that the designer can change information such as transfer, address change, etc. with a single application.
