How Is a Trademark Registration Certificate Obtained?

The trademark registration certificate is the document TÜRKPATENT (the Turkish Patent and Trademark Office) issues showing that a mark is officially protected. To get the certificate, the application needs to be filed and the process completed. Here is how to get a trademark registration certificate:

1. Run a Trademark Search

2. File with TÜRKPATENT

Documents Required for a Trademark Application:

• Trademark name/logo
• Applicant information (individual or company)
• Trademark classification (Nice classes)
• Application fee

Right after filing, an application number is issued and the process starts.

3. TÜRKPATENT's Examination

Within 1 to 2 days, the application is processed. After filing, it goes through two examination stages:

Formal Examination

• Missing documents or fees are checked. If something is missing or wrong, a correction window is granted.

Substantive Examination

• Criteria like distinctiveness, similarity, and prohibited elements are assessed.

4. Publication in the Official Trademark Bulletin

The application is published for 2 months. During that period, third parties can oppose the mark. Opposition can stretch the timeline.

5. Registration Decision

Without opposition, or if oppositions are dismissed, TÜRKPATENT registers the mark.

6. Issuance of the Trademark Registration Certificate

If no opposition is filed or oppositions are dismissed, the registration decision is issued. The "certificate fee" is paid and the certificate is obtained.

Getting the trademark registration certificate takes about 6 to 12 months, but circumstances like opposition can stretch the timeline.
