Trademark Watch and Monitoring

Trademark owners need to run an active monitoring process to protect their own marks against similar new filings.

The Publication Phase and the Opposition Process

In the publication phase, namely the 2 months following publication, if an opposition is filed at TÜRKPATENT on the basis of similarity, the Re-Examination and Evaluation Board reviews the application. If the mark is found to be confusingly similar, the application is refused. The opposition process protects a registered trademark from long-term exposure to look-alike filings.

Why Trademark Watch Matters

TÜRKPATENT is not required to notify existing trademark owners of each new application. That means owners must run an active watch themselves. Scanning the 7,000 to 8,000 monthly filings for similar marks is critical to keeping a trademark protected.

A trademark watch also tracks critical dates: publication deadlines, opposition windows, and the issuance of registration certificates. Staying on top of the opposition process, anticipating challenges from competitors, and being ready for them all require preparation. A trademark watch is not limited to the filing stage; after registration, it covers the periodic checks needed to keep the mark protected.
