1. Assignment

A patent application or a granted patent can be assigned to another person or entity. A patent grants the inventor the right to use, manufacture, sell, and license the invention for 20 years. In an assignment, those rights pass to the new owner.

2. License

A patent license is the transfer, for a set period, of the right to use, manufacture, sell, or distribute an invention covered by a patent or utility model application.

Patents, like other assets held by companies or individuals, can be subject to sale, inheritance, or rental. A patent license lets the patent holder rent the invention to third parties in exchange for a fee.

3. Transfer by inheritance

Patents, like other assets held by companies or individuals, can pass by inheritance. If a patent passes by inheritance, the change has to be recorded in the relevant registry.

4. Pledge

A pledge is a limited real right created for a creditor over a specific asset or property. It secures repayment of the debt owed to the creditor. As noted earlier, like owned goods or property, a patent application or a granted patent can also be pledged.

5. Title or legal form change

If the title or legal form of the patent or utility model applicant or holder changes, the change has to be recorded in the relevant registry. The registry record for a title or legal form change applies to all industrial property rights and applications registered in the holder’s name. Legal proceedings are initiated with a Trade Registry Gazette document showing the title or legal form change.

5. Address change

If the address of the patent or utility model applicant or holder changes, your patent agent needs to file with TÜRKPATENT (the Turkish Patent and Trademark Office) to have the change recorded. The registry record for an address change applies to all industrial property rights and applications registered in the holder’s name.

If the address shown in an opposition or other filing submitted by the patent agent is the old address, the newly declared address is recorded in the registry.
