Types of Logo Registration

In trademark applications, the most frequently used visual elements are photographs, pictures, drawings, logos, and emblems. Logo registration applications typically split into two categories: figure-only applications and logo plus word applications.

1. Logo Applications Without a Brand Name

Logo applications fall under figure-based applications. Figure-based applications are also assessed for distinctiveness, and this requirement is no different from other trademark types.

If a logo or emblem includes sector-specific shapes, that shape must have distinctive features. For example, a logo with a spoon for the restaurant sector needs additional elements to make it original.

When assessing figure-only logo applications for distinctiveness, the question is whether the logo can be told apart from other applications within the requested classes. For a logo to qualify as distinctive, it either has no resemblance to the goods or services in the application, or, if it uses a shape common in the sector, it has moved away from that sector's traditional visual elements. A trademark application for perfume, for example, cannot be a plain perfume bottle.

2. Logo Applications With a Brand Name

In applications combining "Figure and Word" elements, when the brand name and the logo are joined in a distinctive way, the application gains distinctiveness.

Filing with a distinctive logo raises the chance of registration. Even if the brand name or the word element is not distinctive on its own, a mark built around a distinctive logo can qualify as distinctive overall, as long as the logo is in the foreground or noticed at first glance.

How to Register a Logo

The first step in logo registration is preparing the required documents. These are:

Individual Application

Applicant identity details: name, surname, ID number, contact details. High-resolution image of the logo. Classes of goods or services in use. Power of attorney (no notarization required). Bank receipt for the application fee.

Company Application

Company details: trade name, tax number, tax office, contact details. Tax certificate. Activity certificate. Power of attorney (no notarization required). High-resolution image of the logo. List of goods or services covered by the application. Bank receipt for the application fee.

Before filing, the second step is to research your logo to confirm it is unique. After that, a logo registration application is filed with TÜRKPATENT (the Turkish Patent and Trademark Office).
