Design Registration Procedure

The design registration procedure in Turkey has four main stages:

1. Formal Examination

Design registration filings are first put through a formal examination. This stage checks whether the filing includes the required documents. It does not examine whether the design has been registered before or resembles any other design. Only the formalities of the filing are checked.

2. Recording in the Design Register and Publication

After the formal examination, the filing is recorded in the design register and published by TÜRKPATENT (the Turkish Patent and Trademark Office). The filing is published in the Industrial Designs Bulletin for three months. During that window, the design is open to opposition.

3. Opposition Stage

During the publication window, real and legal persons can file oppositions against the published designs. Oppositions can be filed on grounds of novelty and distinctive character. If no opposition is filed within the three-month window, the design registration process continues. Even if that window closes without opposition, the invalidity of the design can still be claimed in court.

4. Certification

If the opposition stage ends without opposition, the design registration is finalized. TÜRKPATENT issues the design registration certificate to the applicant.

Design Registration Renewal

Registered designs are protected for 5 years from the filing date. That protection can be renewed in 5-year periods up to a total of 25 years. Timely renewal matters for keeping the protection in force.
