What Is a Logo Patent?
In Turkey, logos are protected by trademark registration, not patents. A trademark application filed with TÜRKPATENT (the Turkish Patent and Trademark Office) brings the logo under legal protection. A "trademark" can be made of any kind of sign (word, shape, color, sound, shape of goods/packaging, etc.). So a logo (shape) can be registered as a trademark. A patent protects technical inventions; it does not apply to logo protection. What people call a "logo patent" is in practice logo registration.
A logo (a sign made of shape and color) falls within trademark. A logo is protected by trademark registration. A patent or utility model application is for a useful invention or technical model. A logo does not fall within that scope. Industrial design, on the other hand, protects a product's appearance. For example, a packaging shape or ornamentation on a product surface can be protected by design registration. But since a logo's essential function is to indicate the source of goods or services, it is governed by trademark law rather than design law.
During logo registration (so-called logo patent), similar registered marks should first be screened through a preliminary search. The application can go through a trademark agent like Sistem Patent. The completed Trademark Application Form goes to the Sistem Patent trademark agent. The required documents are: the application form and the applicant's identification or commercial details. A specimen of the logo and the list of goods or services applied for are also needed. The list is prepared under the Nice Classification. A power of attorney is added if present. A priority document is submitted if available. Receipts for paid fees are also included. Registration requires an additional application fee per class and a trademark agent consulting fee. The full process after filing typically runs 5 to 8 months.
